Harvey River Bridge Estate ('HRBE')
Please read these Terms and Conditions carefully before placing an order with HRBE for the purchase of goods. By placing an order with HRBE, you acknowledge that you have read, understood, and agree to be bound by, these Terms and Conditions.
1. Liquor Licence
HRBE is located at Lot 22 Third Street, Harvey, Western Australia. HRBE operates under Producer's Licence number 6180070607 granted to Harvey Fresh (1994) Ltd pursuant to the Liquor Control Act 1988 (WA).
2. Age Restriction
Under the Liquor Control Act 1988 (WA) it is an offence to sell or supply liquor to a person under the age of 18 years or for a person under the age of 18 years to purchase, or attempt to purchase, liquor. By placing an order with HRBE you confirm that you are at least 18 years of age. HRBE reserves the right to request identification prior to and upon delivery of goods and will not deliver goods to you if you are unable to prove that you are over 18 years of age.
3. Orders
Once you place an order, HRBE may, in its absolute discretion, choose to accept your order. An agreement between yourself and HRBE comes into existence when HRBE receives and accepts your order.
4. Prices
All prices are quoted in Australian Dollars and include GST.
The prices of goods quoted on the HRBE website, and in your order, do not include freight or handling fees which apply in respect of each order. The total amount payable by you is the price for the goods ordered together with the applicable freight and handling fees.
The prices of goods advertised on the HRBE website are subject to change without notice. The price payable for goods is the price applicable to those goods on the date that they are ordered. HRBE is not bound to supply goods at prices displayed on its website if those prices are incorrect.
5. Payment
HRBE will not dispatch your order until it has received full payment for the goods ordered plus any additional freight or handling fees that apply. Payment can be made by credit card (MasterCard, Visa, American Express, Diners). If you cannot pay by credit card, please contact HRBE as HRBE may, in its absolute discretion, be able to accept payment by an alternative method.
All credit card payments are processed securely through the SecurePay Third Party Gateway and Westpac Australia, using a 128 bit SSL Encryption software to ensure your personal details are kept safe. HRBE does not retain credit card details.
6. Product Availability
All goods are sold on a "while stocks last" basis. HRBE will use its best endeavors to keep its website up to date. However, in some cases, stock may run out before HRBE has the opportunity to update its website, particularly in relation to limited release items. If this happens, and if a particular vintage of goods is no longer in stock after you have placed your order, it will automatically be replaced with the next vintage. If you are not happy with this, you may return the goods to HRBE for a refund of the purchase price of the goods, provided that the goods are received by HRBE unopened, undamaged and in saleable condition.
7. Delivery
HRBE will use its best endeavors to deliver all goods within 5 to 10 business days after an order is placed and payment has been received. However, HRBE does not guarantee delivery within this time frame and is not liable for any loss whatsoever resulting from later delivery. In addition, delivery to remoter areas may take longer.
HRBE will arrange for delivery to the address nominated in your order ('the Delivery Address'), provided that the Delivery Address is within Australia and is a residential or business address.
HRBE reserves the right not to sell certain goods to persons to whom the sale of those goods is restricted or prohibited, or to deliver goods to locations where the sale and/or delivery of those goods is restricted or prohibited, including areas that are deemed to be dry zones by law. You agree not to use a Delivery Address that it is in such an area.
It will be presumed that anyone at the Delivery Address who receives the goods is authorised to do so on your behalf. HRBE may request that the person who receives the goods provide satisfactory evidence of their age. HRBE will not deliver goods to persons under the age of 18 years or to persons who fail to provide satisfactory proof that they are 18 years or over.
If there is no-one at the Delivery Address, or no-one of appropriate age to receive the goods when they are delivered, a calling card will be left asking you to contact the relevant courier. If the courier is Australia Post, the goods will be held by your local post office until you are able to collect them (the goods will be held for a maximum of 14 days).
HRBE takes no responsibility for inability to deliver goods by reason of events that are beyond its reasonable control.
8. Risk and Title
All risk in, and title to, the goods passes to you upon delivery of the goods to the Delivery Address.
9. Returns and Refunds
If you are not satisfied with the quality of any goods delivered to you, you may contact HRBE within 5 business days of delivery of the goods and HRBE will assess your request for a credit, refund or exchange.
If you believe that the goods you have purchased contain a fault, the goods must be returned to HRBE with the remaining wine or product left in the bottle/s for analysis.
Please note that refunds will not be given if you simply change your mind.
10. Intellectual Property
You acknowledge that any trade marks or logos that appear on the HRBE website and on goods sold by HRBE are owned by, or licensed to, HRBE or its related corporations. You agree not to do anything that could prejudice the rights of the trade mark owner or licensee in relation to such trade marks or logos.
11. Export enquires
Please direct all enquiries for the sale of wine to overseas markets to the HRBE Export Department by emailing glillee@harveyfresh.com.au, or see the "Trade Enquiries" contact details on the HRBE website.
12. Variation of these Terms and Conditions
HRBE may add to, delete or vary these Terms and Conditions at any time by posting such changes to the Terms and Conditions on the HRBE website. If you place a subsequent order with HRBE after such changes are posted to the website, you will be deemed to have accepted the changes.
13. Termination
HRBE reserves the right to terminate any agreement at any time by notice to you. Termination is effective on the day the notice is received by you, or a later date if specified in the notice.
14. Miscellaneous
HRBE's agreement with you, including these Terms and Conditions, is deemed to be made at its premises at Lot 22 Third Street Harvey, Western Australia, and is governed by the laws of Western Australia.
If any provision of these Terms and Conditions is unenforceable or void, either in whole or in part, then that provision (or part) is deemed to be deleted without affecting the validity or enforceability of the remainder of the Terms and Conditions.
15. Privacy Policy
HRBE is committed to protecting any personal information it collects. Personal information will only be collected, used and disclosed in accordance with applicable National Privacy Principles set out in the Privacy Act 1988.
The information HRBE collects from you will only be used and disclosed as necessary to perform HRBE's functions or activities, including processing your order for goods, delivering your goods, responding to your enquires and providing you with information relating to goods. All personal information will be managed confidentially and securely and will be destroyed appropriately when no longer required.

The HRBE website uses 'cookies'. These are small pieces of information that are sent from HRBE's server to your computer to enhance the performance of HRBE's website. HRBE's cookies do not contain or collect any personally identifying information and are not used to create customer profiles.
